Abstract

This research was conducted with the aim of knowing the process of implementing credit agreements between the bank and the customer, to find out the rights and obligations and regulations that apply to the home sale and purchase agreement on credit between the bank and the customer in the savings bank between countries and knowing legal liability if one the party made a mistake on the basis of default. The research used was descriptive by using a normative approach. Data obtained through research on legal responsibility for the housing sale and purchase agreement on credit was located at the research location in the savings bank of the slamet riyadi branch in Surakarta, Central Java. with the method of collecting data through document and field studies. the data analysis technique of this research is qualitative data analysis. the results show that the credit application process at the beginning of Bank BTN opened a slamet riyadi branch office in Solo serving customers quickly and accurately but the Credit section must always be careful and careful, to avoid problems in the future, applicable rights and obligations are regulated by Law Number 10 of 1998 and Law Number 8 of 1999. In the case of legal liability in the agreement on Housing Loans with errors carried out by one of the parties namely the consumer (customer) is a defaulted act which is governed by article 1243 of the Civil Code.
