Abstract

In indentically buying and selling gamelan, there was an agreement between the seller and the buyer, in which the buyer ordered 40 sets of gamelan to the seller with a maximum period of completion on December 5, 2012, but the contents of the agreement were denied so that a unilateral cancellation occurred. With the cancellation the buyer feels aggrieved then submits a claim to the District Court on the basis of default, therefore this study aims to find out the legal buying and selling process which then goes wrong so that filing a claim, knowing the verification test, knowing the consideration of the judge's decision. This study uses a normative approach because it is examined by the rules of law, legal principles, legal aspects in the case settlement process. This type of descriptive research is because to describe thoroughly the case settlement process in buying and selling gamelan by pivot. The results of the study show that buying and selling is buying and selling done by ordering gamelan to the seller according to specifications, payment and timeliness. Legal gamelan buying and selling must be through an agreement from the contents of the agreement but violated by the seller because the order is not in accordance with the specifications, late in the delivery schedule, so the buyer feels aggrieved and sued at the District Court, proven by the Defendant The Plaintiff can prove the arguments of the claim and the Defendant cannot prove his arguments, so that the judge decides the Plaintiff's claim is partially granted, the Defendant is sentenced to pay compensation to the Plaintiff jointly and punish the Defendant for paying the case costs incurred.
