Abstract

Freight / shipping of goods is the transfer of goods from the place of origin to the destination. This study aims to determine the process of carrying out freight / shipping agreements, regulations and the rights and obligations between J&T Express and the sender and legal responsibility if one party makes a mistake on the basis of default and / or unlawful conduct. The method used in this study is the normative approach method because it examines the legal aspects, legal rules, and legal principles relating to legal responsibility between J&T Express and Sender. This type of research is descriptive because this study explains how the process of implementing the agreement between J&T Express and the sender in delivering goods is accompanied by their rights, obligations, and legal responsibilities. The results of the research show that the process of implementing the freight / shipping agreement is before the agreement takes place, the parties must fulfill the administrative requirements and legal requirements. Then at the time of the agreement the parties were marked by the signing of the agreement to transport / deliver goods made by J&T Express based on the standard agreement. After an agreement is made, a binding legal relationship arises that gives birth to rights and obligations. J&T Express rights are the sender's obligation, the sender's rights are an obligation of J&T Express. If one party does not fulfill its obligations, due to default, then under article 1237, article 1238 of the Civil Code he must compensate and if for his fault he does not have the good intention to violate the written law and not be careful so that the sender is harmed, then according to Article 1365 of the Civil Code he must compensate.
