Abstract

In this study, researchers will examine the settlement of land purchase disputes where previous sellers and buyers have agreed to sell belitanah transactions and have made a sale and purchase deed but the seller will not agree to the agreement and cancel the sale and purchase The approach method used in this paper is the normative approach because the ones studied are legal norms, and the legal principle regarding the sale and purchase of land so that it can be seen from the legal position in settling the sale and purchase dispute due to unilateral cancellation byseller. the type of research used by the writer is a type of descriptive research, because it is intended to describe the whole of the sale and purchase dispute due to unilateral cancellation by the seller. Research results obtained; a) That the Plaintiff has agreed and agreed to purchase land which is the right of inheritance of the Defendants I up to. XI legacy of the late RMT. wiryodiningrat namely the land perceel the former Recht Van Eigendom (RVE) Vervonding Number: 295, Sriwedari Surakarta City covering an area of approximately 99,889 M2. Without reason and reason that is clear and justified by law, Power of Attorney in Notarial Deed No. 04 March 03, 2006 (as part of deed) unilaterally on December 4, 2009 has been revoked with Notarial Deed Number: 14 made by and before the Defendant XII (Tri Budi Esti, S.Hnotary / PPAT) in Surakarta, legal actions which, accordingly are invalid and the Revocation of the Power of Attorney is legally flawed and has no legal force with all its consequences; b) The Judge stated that the Defendant could not provide justifiable reasons in the applicable lawRevocation of Power of Attorney in Notarial deed No. 04 dated March 3, 2006 by Defendants I to XI of the Plaintiff, as Notary Deed No. 14 December 9, 2009 made by and before the Defendant XII carried out unilaterally without consent and deliberation is an actagainst the law, and harming the Plaintiff as the owner of the land claim 1 claim that has been bound by the agreement and agreement with the Defendants I up to X1; c) The judge decides among others, namely: Declaring lawful according to the law of Notary Deed No. 03 dated March 3, 2006 which contains the agreementrelease of rights to the land of perceel former Recht Van Eigendom (RVE) Vervonding Number: 295 Sriwedari Surakarta City of Central Java Province and Declare according to law that unilaterally revoked by Defendants I up to XI from the plaintiff on Power of Attorney in Notary Act (Mrs. Silviani Tri BudiEsti, SH.notary / PPAT in Surakarta) is not legally enforceable.
