Abstract

The country of Indonesia is a state of law, protection and respect for human rights are the main pillars in every country of law. Where protection and respect one of them needs to be given to the suspect a criminal act because in practice the suspect is often violated by the rights he has. The formulation of the problem in this study is (1) What is the legal protection of the suspect's rights in criminal case investigation? (2) What is the potential for violating the legal rights of suspects in criminal investigations? The research method used in this study is juridical empirical. The results of this study are the legal protection of the suspect's rights in criminal case investigation through two ways, namely preventive emphasis on efforts to prevent violations regulated in several laws and repressions which are emphasized on sanctions for violating the rights of suspects. Potential violations of the legal rights of suspects in criminal investigations the author conducts interviews with 5 people who have been suspects and stated that if their rights are violated caused by the knowledge of suspects, law enforcement officers, the law.
