Abstract

This study aims to determine the legal protection efforts for parties in the PT Menara Santosa pre-project housing system. This research is a normative legal research whose data is obtained based on library research on several sources both in the form of legislation, books, and journals relating to the pre-sale housing system. The results showed that the legal protection of consumers in the contract of sale and purchase with the pre-sale housing system at PT Menara Santosa when viewed in accordance with Law Number 1 of 2011 concerning Housing and Settlement Areas, which is known that at PT. Menara Santosa places too much emphasis on risk to buyers or matters related to providing legal protection to consumers. The concept of pre-project sales actually benefits both parties, which developers do business without capital and buyers can own a house just by paying the fee booking.
