Abstract

In the modern era, transportation is an essential thing in human activities. Although, we could classified transportation as a new human primary needs. The innovation of the online transportation that has been appearing in the modern era. This innovation has become a very practical choice for every generation. The existence of online transportation bring up the new law phenomenon, one of it is the agreement between the company with either the partners or the drivers. One of the biggest online transportation company that operate in Indonesia is Go-Jek. In the company there is an agreement between the company with those who enrolls as a partner, which is called as partnership agreement. In order to be go-jek partner, those potential driver must agree and obey with the partnership agreement . The partnership agreement is a new kind of agreement where there are no norms that control it before. Therefore, the author of the agreement is trying to find out how is the exact form of the law construction in this kind of agreement. Based on the data obtained in the form of a Go-Jek contract partnership agreement, The author discover the various aspects of subject, object, the rights and obligations, regulation about breach of contract and overmacht. From that aspects, the author tried to investigate how the construction of the law and legal protection in the contract agreement of this partnership. The author do the research with some of the norm and doctrine in the authorization agreement and civil case, which is both of it are named agreement in the Book of the Law of the Civil Code, strengthened with the norm and doctrine agreement in general and ITE regulations.
