Abstract

The murder offense targeted by the offender is the soul of a person who can not be replaced by anything. Criminal provisions concerning crimes directed against people's lives are set out in Book II of Chapter XIX of the Criminal Code, namely Article 338 to Article 350. The settlement of murder offenses can be settled through the judiciary, which needs to be observed that the Indonesian judicial system apparently still can not guarantee a fair and just trial process. Where sometimes there is still a punishment that is less fair or less appropriate with the consequences of a crime committed by a defendant. Against the application of the law in the murder offenses case, it must be based on the facts of the trial, so that later will be judge's legal consideration in deciding the verdict Keywords: Murder Crime, Judge Consideration, Obstacles in Criminal Decision
