Abstract

Cooperatives whose members each have a direct interest in lending and borrowing and aims to assist the borrowing needs of members who are in desperate need with light conditions and interest. This study aims to determine the implementation of lending and borrowing agreements, rules and rights and obligations between cooperatives with customers, and know the legal responsibility if one party to default. The method of research is normative. The nature of descriptive research which where describe thoroughly and systematically about lending and borrowing agreement. The result of the research shows that in performing loan and lending agreement before the agreement has to fulfill the administrative requirement and legal requirement. Then at the time of the agreement both parties signed the agreement made by the cooperative. After signing the two parties are bound to enter into a loan and lending agreement, because both parties have a legal relationship to exercise their rights and obligations. The right of the cooperative is the obligation of the customer, the right of the customer is the obligation of the cooperative. In the event that one party does not perform an obligation, it shall be liable on the basis of default. So in article 1243 of the Civil Code concerned shall be liable to indemnify.
