Abstract

Child is a mandate of God, holy, asset of the nation and the generation continues therefore grow and development of the child need to be guarded and protected. However, not all child get a chance to grow well, one of the factors is because it is caused by parents of babies who are in trouble with the law. Using empirical juridical research, juridical and case approaches, with primary data types and descriptive analyzes. The results of this study formulate, firstly, that Indonesia's positive law provides protection for babies who are brought by their mothers in hause of state custody, in the form of the right to live, grow and develop, the right to identity and citizenship, the right to know parents, to be raised and cared for by their parents, the right to receive appropriate education, the right to health care and social security, the right to freedom of worship, expression and thinking, the right to the best of the environment, the right to the protection of all things which may be detrimental and the right to get breast milk. The role of the prison guards in protecting the baby brought by his mother, consists of aspects of prevention,security, escort and guarding.
