Abstract

The Commission for the Supervision of Business Competition (Komisi Pengawas Persaingan Usaha or “KPPU”) until 2016 has handed down a decision for 11 cartel case and recently has handed down a decision for two cartel cases based on Law Number 5 Year 1999 on Prohibition of Monopolistic Practies and Unfair Business Competition Article 11 and Commision Regulation Number 4 Year 2010 on Guidance of Article 11 Law Number 5 Year 1999 on Prohibition of Monopolistic Practies and Unfair Business Competition. Through the decision of case No.10 KPPU-I/2015 and decision of case No.02/KPPU-I/2016, decided that the business actor in this case has been proven legally to violate Article 11 Law Number 5 Year 1999 on Prohibition of Monopolistic Practies and Unfair Business Competition. This research is a legal research conducted with a qualitative doctrinal approach and deductive reasoning. Type of study in this research is more descriptive, because it intends to describe clearly about various matters related to the object, namely the decision of case No.10 KPPU-I/2015 and decision of case No.02/KPPU-I/2016. This Research aims to know the legal considerations of the Commission Council in deciding the selling price of livestock in the a quo case, considering that Commission Council in assessing the cartel cases will using Rule of Reason method to listen the reason from reported, probably it is possible the action reported it could otherwise support the existence of business competition climate.
