Abstract

This research aims to determine the form of legal protection for blank bilyet giro receivers, the efforts which can be done to prevent blank bilyet giro, the legal consequences for the issuer of blank bilyet giro and the judge's judgments according to the verdict number 68 / Pid.B / 2016 / PN.Ska. This is a normative legal research supported by field research. The type of data used is secondary data. Secondary data sources include primary legal materials and secondary legal materials. For primary law materials, data collection techniques employed are literature studies, document studies and interviews with judges from the Surakarta District Court. Furthermore, the data were analyzed using qualitative and deductive syllogism. The following results are obtained: (a) Protections for bilyet giro receivers could be established through both criminal justice and civil law courts. (b) Attempt done by banks that is to pay attention on the procedures of receiving customers, while people should be more concerned with the use of transfer form. (c) The legal consequences for the issuer of blank bilyet giro might be in the form of criminal sanction, civil sanction, and name inclusion in the national black list. (d) The judges, in dropping the verdicts number 68 / Pid.B / 2016 / PN.Ska, have noticed various considerations and decided the case in accordance with applicable regulations.
