Abstract

This study aims to find out the practice of leasing the village cash land according to the law in Desa Village, Kecamatan Kartasura, Kabupaten Sukoharjo and responsible the tenant's law in case of default. The research method using normative approach method is descriptive. Sources of data consists of primary data ie interviews and secondary data namely primary, secondary and tertiary legal data. Methods of dat a collection through literature study and interview, then the data were analyzed qualitatively. The results showed that the practice of renting the village cash land in Desa Pabelan Kecamatan Kartasura Kabupaten Sukoharjo is in accordance with the Civil Law Act 1320 which is full of validity in the agreement that is agreed to bind themselves in the oral agreement that has been made by the perpetrators with a decree set by the village head who was issued after obtaining BPD approval and obtained written permission from the Bupati and the Governor. The legal consequences in the event of default are tenants charged with compensation in the form of money that will be used to purchase another better land located in the local village. Based on the facts, the authors get a unique lease system where the rent of village cash land is done by auction system. The system is permitted by law so as not to violate the applicable provisions in Indonesia
