Abstract

This study aims to determine the process of agreements and regulations relating to the sale and purchase of land and the rights and obligations between the seller and buyer and legal liability if one party made a mistake in the sale and purchase of land. The method of research using normative approach method means to examine the kaedah-kaedah and the principles of law and is descriptive meaning to explain about how the rule of law against the sale and purchase of land. Sources of data consists of primary data ie interviews and secondary data namely primary, secondary and tertiary legal data. Methods of data collection through literature study and field study (interview), then the data were analyzed qualitatively. The result of the research shows that the process of land purchase agreement must fulfill the material requirement that there are buyer, seller and land object, then the formal requirement includes the original land certificate, the proof has paid the PBB, the letter of deposit of BPHTB, the PPh payment letter, and the data of the seller and buyer data including : KTP and KK. Regulations relating to the sale and purchase of land are regulated in the Civil Code (Civil Code), Government Regulation No. 24/1997 on Land Registration, Law No. 5/1960 on Basic Agrarian Basic Regulations. Legal liability if the buyer made a mistake such as canceling the agreement then must pay compensation (section 1276 KUHPerdata). In the meantime, if the mistake is made by the seller, it will compensate the losses suffered by the buyer due to the unlawful acts committed by him (article 1365 KUHperdata).
