Abstract
ABSTRACT The rights of a dependent is legal protection for creditors if the debtor cannot perform its obligations to pay off its debts to creditors. Repayment of debt creditors is carried out by way of guarantee of the rights of a dependent object sales through public auctions. The problems in the auction occurs when the auction winner can't master the auction object bought due to the discharge of his difficult and the existence of a lawsuit from the debtor or a third party. Legal protection should be given against the winner of the auction which means the existence of legal certainty the rights auction winner of the object bought through the auction. An auction process that has been done will give rise to legal consequences, namely a transitional object rights auctions from the seller to the auction winner. In the transitional object rights auction turned out to cause a problem, as it can not be mastered by the winner of auction the auction object, as well as the cancellation of the auction based on the verdict. This research was conducted to find out how legal protection for the auction winner execution rights remedy dependents and anything that can be done by auction buyers. This research was conducted with normative juridical method. The results of this study concluded that positive law governing the auction of Indonesia namely Vendu Reglement, HIR, and FMD FMD. Number 106/06/2013 Number Of changes to the FMD FMD. 93/06/2010 and Number 93/FMD FMD. 06/2010 About the auction Guidelines Keywords: legal protection. Auction Buyers. dependent rights.
