Abstract

This study aims to determine the case of dispute permit of investment principle in Decision Letter Number 080/G/2015/PTUN.Smg seen from the principle of absolute competence PERATUN and to know the judge's judgment analysis in deciding dispute permit principle of investment. The research method used a descriptive normative juridical approach. Sources of data derived from secondary data comprised of primary and secondary law sources. Methods of data collection with literature study and other legal documents, then the data are analyzed qualitatively. The result of the research shows that the issue of dispute case of investment principle permit is seen from the principle of absolute competence of PERATUN is in accordance with the State Administration Judicature Law and Government Administration Law. Related to the Decision of State Administration between PT. Amira as Plaintiff with Head of BPMPT of Cilacap Regency as Defendant regarding Decision Letter Number 348/3301/ IP/I/ PMDN/2014 as a whole is in accordance with laws and regulations, so it indicates that the Decision of State Administration can be legally accountable. The legal considerations of the judge in deciding the dispute permit principle of capital investment with the verdict rejected the Plaintiff's.
