Abstract

This study aims to determine the process of execution of buying and selling Flats and to determine the status of ownership of land rights consumers after the installment paid off. The research method used the normative juridical method which is descriptive. Data source consists of primary data that is result from interview and secondary data that is primary, secondary and tertiary legal data. Methods of data collection by literature study and field study (interview) then the data were analyzed qualitatively. The results showed that before the agreement is made that the consumer must know the state of the flat, complete the administrative requirements and meet the terms of the agreement to the developer; The agreement between the parties (bank, consumer and developer) shall be called a consensual agreement that is deemed valid if there is an agreement or consensus between the parties as evidenced by the deed made by the Land Deed Authority (PPAT) for the property rights certificate of the apartment unit and By Sertifikat Kepemilikan Bangunan Gedung (SKBG) Unit of Flats. The status of the apartment ownership includes the ownership rights of individuals used vertically and horizontally, the collective right over the part of the building, the objects, the land, all constituting an integral functional entity, which is a geometric shape of 3 (three) dimensions that is not Always limited by the wall.
