Abstract

The purpose of this study is to know the process of eement, right and obligation of rent between the parties in car rental and know the responsibility of law if one side violate the rent car rental agreement in Sukoharjo Regency. The research method uses normative juridical method that is descriptive. The data source consists of primary data namely interviews and secondary data namely primary, secondary and tertiary legal data. Methods of data collection through library study and field study (interview), then data are analyzed qualitatively. The result of the study concludes that the process of rental car rental arrangement conducted by Santai Trans and Campus Car Rental in Sukoharjo Regency is one of the types of lease agreement between the two parties, while the rights and obligations in accordance with article 1550 and article 1560 of the Civil Code. Regarding the responsibilities arising in the lease agreements, if one of the parties makes a mistake such as default and illegal acts with the risk that the parties must bear such as the natural risk, the risk of damage when the car is in the hands of the tenant and the risk Arising in overmacht, the parties shall indemnify the liability in accordance with the offenses committed and in accordance with the terms of the agreement.
