Abstract

Law Number 21 of 2008 on Islamic Banking has been enacted on July 16, 2008. Nevertheless, research on Sharia Banking is still interesting to be studied let alone reviewed from how the chronology of the formation of Law Number 21 of 2008 concerning Sharia Banking. In addition, in the Transitional Provisions, Article 68, which regulates the spin off of UUS to Sharia Banking, is also interesting to examine on how the legal political configuration of Article 68 of Law Number 21 year 2008 on the implementation of spin off on Sharia Banking. This study aims to determine the chronology of the formation of Law Number 21 of 2008 concerning Sharia Banking and legal political configuration Article 68 of Law Number 21 Year 2008 on the implementation of spin off on Sharia Banking. This study used a qualitative approach, based on literary studies. This study uses primary data in the form of Law Number 21 Year 2008 concerning Sharia Banking and for secondary data of its primary form of book Chronology Discussion of Bill on Sharia Banking from DPR RI. Data collection techniques used literature study techniques and data analysis using descriptive analytical and content analysis. The results of this study, first, the chronology of the formation of Law Number 21 of 2008 on Sharia Banking begins with RDPU with Asbisindo, then draft proposed Bill approved by the House Leadership and discussed the Commission XI DPR RI. The House of Representatives Commission XI held meetings with the Government, there was Raker, Panja, Timus and Timsin, afterwards reported back to the House Leadership and finally on July 16, 2008 approved by the President. Second, the legal political configuration in the process of forming Law Number 21 of 2008 concerning Sharia Banking, especially article 68 on spin off including democratic political configuration with responsive legal product character.
