Abstract

This research is aimed to find out and to describe the implementation of the Letter of Authority in praxis and to find out the legal consequences of using The Letter of Authority in the Land Title Transfer. The method in this research is normative legal research (juridical empiric) and sociological law research with the use of primary data and secondary data. Literature study, documentation, and interviews are the data collection techniques and then they are analyzed with qualitative analysis. It can be concluded from the research that the Letter of Authority is still being used in praxis, however The Letter of Authority in this context is not the one stated in Ministry of Home Affairs Instruction No. 14 of 1982. The Letter of Authority meant by Ministry of Home Affairs Instruction No. 14 of 1982 is the agreement of authority delegation which is not attached with the main agreement; this means that the authority is stand-alone. The consequences of using Letter of Authority in Land Title Transfer is that it will be voided, and thus the receiver of authority delegation is obligated to transfer the land rights bestowed to him back to the giver of the authority or other party who fulfills the requirement if that authority is given before Ministry of Home Affairs Instruction No. 14 of 1982 exist.
