Abstract

Nowadays the case that often experience pro and contra in legal field is the case that related to negligence. Negligence is usually done by most community such as traffic accident. Police on duty in determining status of suspect must understand regarding the formulation of a criminal offense, due to lack of interpretating formulation of a criminal offense will certainly affect on indicate if there are a relation series of actions with consequences. Using empirical juridical methods, a procedure that used to solving research problem with researching secondary data then proceeding to conduct research on primary data in the field. To attest the alleged suspect is from the crime scene, listening to the testimony of witnesses and the elements of article. These aspects are customizable. Barriers to law enforcement authorities in processing the traffic accidents are the relationship to the witnesses and suspects.
