Abstract

The evidence of the accused or the suspect is guilty or not depends on the eviidence hat has been used to commit a felony or misdeneanor. To protect and ensure the integrity of the evidence the law had arranged this, as in the case of narcotic crime. In obtaining evidence, the investigator must also consider the applicable procedures so that arbitrariness by the investigator to conduct seizure of evidence. This research uses empirical juridical approach using interview techniques in collecting the data. This research is included in the description research. Based on the results of research and discussion that has been done can be concluded that the Surakarta Police investigators in performing seizure of evidence tend to use foreclosures techniques in urgent circumstances, because of the characteristic of the crime of drug evidence that easily destroyed or hidden by the suspect. Evidence seized narcotic crime by Surakarta Police Departement investigators also proving effective at this stage.
