Abstract

ENGLISH One of requirement human life water and to answer the demand requirement will irrigate hence the human being always reach after. Fundamental requirement irrigate this, in City of Pekalongan supply through formal institute is so-called Company of Drinking Water Area (PDAM) And individual which wish to get clean water have to go through certain procedure, that is by way of registering byself to PDAM of Pekalongan City.. As attached its meter PDAM peripheral in plot of land each its reality that secretary water from this meter PDAM, do not forever in the form of clean water, but at the time of certain the water very dirty and improper drink. With circumstance like this, goods have of course citizen of society becoming customer of this PDAM is discontented and objection, with reason that citizen subscribe to water of clean drink the water but accepted exactly irrigate dirty , though all obligation in the form of fee payment of monthly remain to be paid, but right in the form of acceptance irrigate that moment is not clean, so that the citizen feel got taken by PDAM and citizen feel do not accept its rights as arranged in Consumerism. However citizen socialize to feel to worry because this Consumerism UU have never been reached by people of enforcer punish. Therefore after through process of research and discussion which is long enough, hence the case that happened require to be performed by doing punish professionally with an eye to in order to the parties which responsible can change attitude and take action professional, for the shake of to more improve profit of company. INDONESIA Salah satu kebutuhan hidup manusia adalah air dan untuk mencukupi kebutuhan akan air maka manusia selalu berusaha mendapatkannya. Kebutuhan pokok air ini, di Kota Pekalongan dipasok melalui lembaga resmi yang disebut Perusahaan Daerah Air Minum (PDAM) dan individu yang ingin mendapatkan air bersih harus menempuh prosedur tertentu, yaitu dengan jalan mendaftarkan diri ke PDAM Kota Pekalongan. Dengan telah dipasangnya perangkat meter PDAM di persil masing-masing nyatanya bahwa air yang keluar dari meter PDAM ini, tidak selamanya berupa air bersih, melainkan pada saat tertentu airnya sangat kotor (keruh) dan tidak layak minum. Keadaan demikian ini, sudah barang tentu membuat pelanggan merasa kecewa dan keberatan, dengan alasan bahwa warga berlangganan air minum/air bersih tetapi yang diterima justru air keruh, padahal semua kewajiban berupa pembayaran iuran (rekening) bulanan tetap dibayar, namun haknya berupa penerimaan air saat itu tidak bersih, maka perlu di kaji bagaimana hubungan hukum antara perusahaan air minum dengan pelanggan, bagaimana penyelesaian hukum apabila terjadi perselisihan serta upaya apa yang dapat ditempuh perusahaan dalam meningkatkan perlindungan hukum bagi konsumennya. Meskipun UU Perlindungan Konsumen telah diberlakukan bagaimana pelaksanaannya di Kota Pekalongan dalam kaitannya dengan pelanggan PDAM. Oleh karena itu setelah melalui proses penelitian dan diskusi yang cukup panjang, maka kasus-kasus yang terjadi dapat ditempuh secara hukum perdata, pidana ,administrasi maupun melalui Badan Penyelesaian Sengketa Konsumen (BPSK), demi perlindungan hukum bagi konsumen.
