Abstract

Production sharing agreement is one of the transactions to cultivate agricultural land. This agreement is based on mutual assistance and a sense of kinship that is still very strong among the community which in its implementation is still not following the existing provisions. This study aims to determine the form and content of the agricultural land production sharing agreement, the driving and inhibiting factors in the implementation of the production sharing agreement, and the form of settlement in the event of a dispute. The approach method used in this research is the empirical juridical method or known as field research. The types of data used are primary data and secondary data which include: primary legal materials, secondary legal materials, and tertiary legal materials. The data collection method used is a literature study and interviews. This study uses qualitative data analysis methods by grouping the data obtained from research in the field and associated with data from literature studies. Based on the results of research on the implementation of the agricultural land production sharing agreement in Serangan Village, Sukorejo District, Ponorogo Regency, it was made unwritten only in an oral form based on trust and agreement between the land owner and the cultivator, was not made before the Village Head and there was no written deed or contract from the legal action. In the content of the agricultural land production sharing agreement, there are rights and obligations of the parties, the distribution of the results in the implementation of the agricultural land production sharing agreement mostly uses a 1:1 or maro system, then the period based on research in Serangan Village determines the period in the production sharing agreement. not required or not regulated depending on the wishes of the owner and cultivator as well as the agreement, then the end of the profit sharing agreement, and also the risk that can exist in the profit sharing agreement, namely crop failure. The driving factors in the implementation of the production-sharing agreement include land owners who cannot or are not skilled at working on their land, and cultivators who do not have land to cultivate and only have expertise in agriculture then the inhibiting factor is that the production-sharing agreement is not implemented following the provisions. which is in Law Number 2 of 1960 and crop failure caused by bad weather or pests, if there is a dispute the parties choose to use alternative dispute resolution by way of negotiation
