Abstract

Adoption of a child is a legal act by transferring the rights of the child from the power of his parents, family, legal guardian, or other person who is responsible for the care, education and rearing of the child, then these rights are transferred to the responsibility and power of the adoptive parents. The purpose of adoption is for the sake of the interests of the child so that the future of the adopted child can be guaranteed as well as the welfare and protection of the child in accordance with Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. From the adoption process, there will be legal consequences, one of which is the inheritance rights of the adopted child. This study has the aim of knowing and analyzing the adoption procedure according to Islamic Law and Indonesian Positive Law, and to be able to find out and analyze the status of the adopted child's position in the distribution of inheritance according to Islamic law and Indonesian Positive Law. This research uses library research method so that this research is included in normative research.
